The following is a list of commonly asked questions regarding abandoned property and encampments, as well as a list of numbers for supportive services in the 13th Council District.
How is the City handling abandoned property and encampments?
Due to two court cases, the Jones case and the Lavan case, the City amended Los Angeles Municipal Code Section 56.11 regarding the storage of items on public rights of way.
On October 15, 2007, the City entered into a settlement agreement in Jones v. City of Los Angeles, in which the City agreed that between the hours of 9 p.m. and 6 a.m., it would not enforce the law prohibiting sleeping on the streets anywhere in the City of Los Angeles until the City makes 1,250 units of permanent supportive housing available in the Skid Row area.
In a separate case, Lavan v. City of Los Angeles, a federal district court judge issued a preliminary injunction enjoining the City from seizing or destroying personal property left unattended on the public sidewalks of downtown’s Skid Row. The City appealed this order to the Ninth Circuit Court of Appeals. The Ninth Circuit held that the removal and immediate destruction of a person’s unattended property violates the United States Constitution. The Ninth Circuit’s opinion applies citywide. In implementing the injunction and the Ninth Circuit ruling, the City has established a process to be used prior to removing or destroying personal property left on sidewalks. This includes providing notice to the owner prior to removal and storing the property for a reasonable period prior to disposing of it. These prerequisites do not apply to items which pose an immediate threat to public health and safety, or is evidence of a crime.
What is the City doing about the accumulation of personal property on the public sidewalks?
In response to the two cases, the City amended LAMC 56.11 to balance the needs of the residents and public at large to access clean and sanitary public areas, with the needs of the individuals, who have no other alternatives for the storage of personal property, to retain access to a limited amount of personal property in public areas.
The City’s Bureau of Sanitation (BOS) is working with the Los Angeles Homeless Services Authority (LAHSA) and other agencies to provide outreach to the homeless individuals as well as to maintain safety in the public right of way. The City has sought to strike a balanced approach: provide help to those who need and want it – and to enforce all applicable laws to protect quality of life.
There is an encampment in my community; is there anything I can do about it?
Being homeless is not illegal. The City’s Bureau of Sanitation, along with LAHSA, have developed a process to ensure that public safety concerns are met. If you would like to report abandoned property or an encampment, you can utilize the City’s MyLA311 SmartPhone app, or call 3-1-1, or the Councilmember’s District Office at 213-207-3015.
Here’s the essential Abandoned Property/Encampment Cleaning Protocol:
- Encampment reported by constituent or Council Office
- BOS assigns an investigator to visually inspects the site
- LAHSA conducts outreach and offers services to the individual
- Owner of property receives a 72-hour Notification of Cleanup to ensure he/she has enough time to collect their belongings
BOS and other agencies schedule a cleanup of the bio-hazard waste in the area. Cleaning an encampment requires specialized training, which requires a certified watershed protection worker.
In addition, the City also utilizes a Homeless Outreach and Proactive Engagement (H.O.P.E.) Team:
The HOPE Team is a collaboration between Los Angeles Homeless Services Authority, Bureau of Sanitation, and the Los Angeles Police Department. Their mission is to engage encampments and proactively connect homeless residents to services while maintaining healthy and safe streets and sidewalks.
What is Councilmember O’Farrell doing to address the homeless situation?
Councilmember O’Farrell has contracted with People Assisting the Homeless (PATH) for a dedicated outreach team in the 13th District, and is funding the Los Angeles Conservation Corps Clean Team to clean sidewalks, alleys, and public stairways of trash, bulky items, and other debris.
Citywide, Councilmember O’Farrell is working to establish an affordable housing policy,which will help create more permanent supportive housing for the homeless. The Councilmember is bringing more affordable housing units to the 13th Council District than any other district in the City of Los Angeles, but feels this must be a citywide effort as homelessness is a citywide problem.
What if I witness or see a crime being committed at an encampment?
Constituents should promptly report crimes to LAPD. Property owners near encampments can work with LAPD and install security cameras with recording devices as well as "no trespassing" signage.
